Claims Against UBS

Deutsch & Lipner Leads in Prosecution of Claims Against UBS for Sale of Lehman “Principal Protected” Structured Products

In November 2008, just weeks after Lehman filed bankruptcy, Deutsch & Lipner filed what we believe was the first case brought against UBS Securities for its sale of Lehman Brothers “Principal Protected” Structured Products. A year-and-half later, that case resulted in total victory for the investor – an award of “rescission.” In addition to that compensation, because UBS had been caught withholding crucial documents, our client was awarded nearly $60,000 more in attorneys fees and expert witness fees.

Since filing that initial case, Deutsch & Lipner has filed individual arbitrations on behalf of over 50 purchasers of investments titled “100% Principal Protected Notes,” “Return Optimization Securities with Partial Protection,” “Performance Securities with Contingent Protection,” “Yield Optimization Securities,” “AutoCallable Securities,” and a host of other so-called Structured Products.

As we have for over 25 years, Deutsch & Lipner is pleased to be ahead of the crowd of lawyers who have announced that they are bringing such claims on behalf of aggrieved investors. Deutsch & Lipner conducted extensive discovery from UBS in the cases we brought, and we obtained many damaging internal communications and research reports issued by UBS that prove up UBS’ wrongdoing. We have read and analyzed thousands of pages of prospectuses and other material, interviewed numerous former clients of UBS, examined many UBS brokers, analysts, executives and experts under oath, and built a powerful and compelling case of deception and greed.

In addition to the arbitration result already mentioned, Deutsch & Lipner’s clients won 2 other arbitrations against UBS involving these same types of securities. Each of these clients was awarded rescission, i.e., they got back all their money. Many of our clients are successful businesspeople or experienced investors, but these usually-negative facts have not diminished our ability to obtain recovery for our clients.

Deutsch & Lipner will continue aggressively to prosecute these claims on behalf of its clients, and we will be filing more cases in the coming days.

Deutsch & Lipner is pleased to offer no-fee in-person or telephonic consultations with other victims of these deceptive sales.
